Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and Theory Academy. Please read them carefully — by creating an account, starting a trial, purchasing a plan, applying for complimentary beta access, or otherwise using the platform, you accept these Terms. If you do not agree, do not use the service.

1. Who we are and how to contact us

Theory Academy ("we", "us", "our") is an independent online driving-theory learning platform, operated from Ireland. "Platform" means our websites, applications and related services. We are contactable by email — support@theory-academy.com for general matters and privacy@theory-academy.com for data-protection matters; we do not currently operate a public postal address. These Terms are provided in English; where we offer translations, the English version prevails in case of conflict.

2. What Theory Academy is (and is not)

Theory Academy is an independent educational study aid designed to help you prepare for driving-theory examinations. We are not a government body, driving authority, examiner, or official test provider, and we are not affiliated with, endorsed by, or sponsored by the Road Safety Authority (RSA) or any equivalent authority. Our questions, explanations and mock exams are for study purposes and do not reproduce official examination content. We do not guarantee that you will pass any test. Nothing on the Platform constitutes legal, safety, or professional advice — always rely on the official rules of the road and current legislation of your country.

3. Eligibility

You must be at least 16 years old to use the Platform and to consent to our processing of your personal data. By using the Platform you confirm that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of another person, you are responsible for their compliance with these Terms.

4. Your account

To access certain features you must create an account and provide accurate, current information. You are responsible for keeping your login credentials confidential and for all activity under your account. One account is for one person; you may not share, sell, or transfer it. Notify us promptly at support@theory-academy.com if you suspect unauthorised use. We may refuse, suspend, or close accounts that breach these Terms.

5. Public and complimentary access

The Ireland course is available through the public plans described below. We may also invite selected testers to receive complimentary beta, promotional, or test access. Complimentary access is granted at our discretion, is personal and non-transferable, does not require payment, does not renew into a paid plan, and may be limited, changed, suspended, or withdrawn. Beta features may contain errors or incomplete content and are provided on an "as is" and "as available" basis. Complimentary access does not create a right to continued or future access.

6. Free trial

Where offered at checkout, the monthly plan begins with a three-day free trial and requires a valid payment method. Unless you cancel before the trial ends, the plan automatically converts to the €20 monthly subscription shown at checkout. You can cancel before billing through the Stripe billing portal. The checkout page and confirmation email show the exact trial end date and control if they differ from a general description on the Platform.

7. Plans, pricing and payments

The current public options are €20 per month after any stated trial, or €59 once for lifetime access to the purchased country course. Monthly subscriptions renew automatically at the price displayed at checkout until cancelled; lifetime access is a one-time payment and does not renew. Prices and any applicable VAT are displayed before purchase. Payments are processed by Stripe, and we do not store your full card details. If the checkout page shows a different price, tax amount, currency, trial, or renewal date, the information you expressly accept at checkout controls that purchase.

8. Your right to cancel (consumers in the EU/EEA)

If you are a consumer, you generally have the right to withdraw from a purchase of digital services within 14 days without giving a reason. Where you ask us to begin providing a paid digital service immediately during the 14-day period, you acknowledge that you will lose the right of withdrawal once the service has been fully performed, and that for partial performance you may owe a proportionate amount. To exercise the right, contact us at support@theory-academy.com with a clear statement before the period ends. These provisions apply only to paid purchases and do not affect free beta access.

9. Cancellation and refunds

You may cancel a paid subscription at any time; cancellation stops future renewals and takes effect at the end of the current billing period, with continued access until then. Beyond your statutory withdrawal right and any non-excludable consumer guarantees, refunds are provided at our discretion. You can request a refund by contacting support@theory-academy.com. Free beta access can be ended by you at any time by ceasing to use the Platform or asking us to delete your account.

10. Acceptable use

You agree not to: (a) use the Platform unlawfully or in breach of these Terms; (b) copy, scrape, harvest, republish, resell, or commercially exploit our content or make it available to others; (c) reverse engineer, decompile, or attempt to extract source code, except to the extent permitted by law; (d) circumvent security, access controls, or usage limits; (e) upload malware or interfere with the Platform's operation; (f) use automated systems or bots to access the Platform without our permission; or (g) impersonate others or provide false information. We may investigate and take action, including suspension, for suspected breaches.

11. Intellectual property

The Platform and all of its content — including questions, explanations, lessons, road-sign material, text, graphics, logos, branding, software, and their selection and arrangement — are owned by the Operator or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own study while you comply with these Terms. All rights not expressly granted are reserved. "Theory Academy" and our logos are our trademarks and may not be used without our written permission.

12. Your feedback

If you send us feedback, suggestions, bug reports, or ideas, you grant us a worldwide, royalty-free, perpetual, irrevocable licence to use them without restriction or obligation to you, and you confirm you are entitled to provide them. This does not affect our privacy obligations regarding your personal data.

13. Third-party services

The Platform relies on third-party providers (for hosting, payments, email, analytics and error monitoring) and may link to third-party sites we do not control. We are not responsible for third-party content, products, or practices; your use of them is subject to their own terms and privacy policies.

14. Availability and changes to the Platform

We aim to keep the Platform available but do not guarantee uninterrupted or error-free operation. We may add, modify, suspend, or discontinue features or content, and perform maintenance, at any time. Experimental and beta features in particular may change or be unavailable without notice.

15. Disclaimers

To the fullest extent permitted by law, the Platform and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to accuracy, completeness, fitness for a particular purpose, or that use of the Platform will result in passing any examination. Study content may contain errors and may not reflect the most current official rules. Nothing in this section limits or excludes any rights or statutory guarantees you have as a consumer that cannot be limited or excluded under applicable law.

16. Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under mandatory consumer-protection law. Subject to that, we are not liable for: (a) indirect, incidental, special, or consequential loss; (b) loss of profit, revenue, data, goodwill, or anticipated savings; or (c) any failure to pass an examination or any decision you make in reliance on the Platform. Subject to the first sentence, our total aggregate liability arising out of or in connection with the Platform is limited to the greater of the amounts you paid us in the twelve (12) months before the event giving rise to the claim, or EUR 100.

17. Indemnity

To the extent permitted by law, you agree to compensate us for reasonable losses, costs, and expenses we incur arising from your breach of these Terms or your misuse of the Platform. This clause does not apply to the extent a loss results from our own breach or negligence, and does not limit your statutory consumer rights.

18. Suspension and termination

You may stop using the Platform and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or if we discontinue the service. On termination, the licence granted to you ends; clauses that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

19. Data protection

We process personal data in accordance with the GDPR and applicable law, as described in our Privacy Policy, which forms part of these Terms. Please read it to understand what we collect and the rights you have.

20. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by email or a notice on the Platform) before they take effect. Your continued use of the Platform after changes take effect constitutes acceptance. If you do not agree, you should stop using the Platform and may close your account.

21. Governing law and jurisdiction

These Terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction. If you are a consumer resident in the EU/EEA, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may also bring proceedings in the courts of your own country.

22. Complaints and dispute resolution

If you have a complaint, please contact us first at support@theory-academy.com and we will try to resolve it. As an EU consumer, you may also seek assistance from your national consumer-protection body or the European Consumer Centre (ECC) network, and, for data-protection matters, from the relevant supervisory authority (see our Privacy Policy).

23. General

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in force. Our failure to enforce a right is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours to a successor of our business. These Terms, together with the Privacy Policy, are the entire agreement between us regarding the Platform. We are not liable for failure or delay caused by events beyond our reasonable control (force majeure).
